David Fontana is a partner at Gebhardt & Smith representing financial institutions, banks and other creditors in commercial loan workouts, restructurings, foreclosures, bankruptcy, asset sales and commercial litigation. David has tried numerous cases in state courts and federal bankruptcy courts and has been involved in binding arbitrations and appeals before various state and federal appellate courts. David also has extensive experience in the areas of loan documentation, forbearance and modification agreements, and loan sale transactions.

David earned his J.D. from Hofstra University School of Law, graduating 3rd in his class and with distinction. While in law school, he was a member of the Hofstra Law Review.

Over the years, David has presented many creditors’ rights and bankruptcy seminars to banking clients and bankers’ associations. 

Prior to his legal career, David earned a B.S. from the United States Merchant Marine Academy, one of the nation’s five federal military academies, graduating 7th in his class, and sailed on ocean-going vessels between 1987 and 1991. He was a recipient of the Eastern College Athletic Conference Division III Scholar Athlete Award, leading the Academy’s varsity baseball team as Captain, playing centerfield. After graduating cum laude from the Academy, David served as a commissioned officer in the United States Naval Reserve, retiring in 1999 with the rank of Lieutenant.
